North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hydraulic lift falling because the safety locking system on the right rear post was not functioning properly. a)Bay #2: The safety device of the right rear post of the Ben Pack, above ground hydraulic lift, used by employees during daily work on automobiles, was observed to be malfunctioning. (ANSI//ALOIM-1994, 4.4.4 & 4.5) Among other means, one feasible and acceptable abatement method to correct this hazard is to lock out the lift until such corrections could be made.
