: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a forklift overturning or having fallen off the forklift, due to the fact that the operator restraint system, (seat belt) provided on the John Deere tractor/backhoe/loader was not being used by the operator. Among other methods, one feasible and acceptable method to correct this hazard is to require and effectively enforce the use of the operator restraint system provided and recommended for use by the manufacturer. On or about November 16, 2004 at the work-site located at Beechwood Ave. in Fayetteville, Arkansas an employee was exposed to crushing injuries from a tractor overturning or having fallen off the forklift, due to the fact that the operator restraint system, (seat belt) provided on the John Deere tractor/backhoe/loader was not being used by the operator.
