29 CFR  1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a) Avenue C between 2nd and 3rd Street, Billings, MT 59101: On or about October 4, 2021, and at times prior, employees were exposed to struck by hazards while identifying underground lines at a depth of 5 feet 4 inches. The employer failed to set back the spoil pile from the edge of the excavation.

29 CFR  1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:   a) Avenue C between 2nd and 3rd street, Billings, MT 59101: On or about October 4, 2021, and at times prior, employees were exposed to cave in hazards while locating underground lines in an unguarded trench at a depth of 5 feet 4 inches. The competent person failed to remove employees from the trench when there was evidence of a hazardous condition.
