Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employee was allowed to operate a Terex Handler, Model No. TH842C and use it to elevate and suspend concrete wall panels without the proper lifting attachment exposed the employees to crushing hazards: a) Flemington Courthouse, 71 Main Street, Flemington, NJ 08822. The employer allowed his employee to operate a Terex Handler, Model No. TH842C and use it to elevate and suspend concrete wall panels when the Operators Manual clearly indicates that this type of work must be done with the proper attachment such as a truss boom. This unsafe activity exposed employees to crushing hazards as the concrete panels weighed in excess of 600 pounds. CSHO observed on or about 09/20/05. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD, AMONG OTHER MEANS, WOULD BE FOR THE COMPANY TO ENFORCE THEIR EXISTING SAFETY AND HEALTH PROGRAM AND CONSULT WITH THE PANEL MANUFACTURER TO DEVELOP A RIGGING AND INSTALLATION PROCEDURE FOR CONCRETE WALL PANELS.E
