5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being crushed and/or caught between the skid steer loader and its parts while in operation: (a) 302 Albright Lane, Bigfork, MT: On or about May 18, 2007, and times prior there to, employees operated Scat Trak skid steer Model 2300D with inoperable safety devices. Among other methods, one feasible and acceptable means of abatement to correct the hazard would be to follow the manufactures recommendations and perform daily inspections of the seat bar and other safety devices on the equipment.s
