Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees; a) in that, the employer did not ensure that forklift operators in the warehouse and shipping dock utilized seatbelts to prevent being crushed-by or struck-by the rollover protection cage in the event of a forklift tip-over while operating forklifts, such as, but not limited too, Nissan Optimum 50, Model C23F475. Among other methods,one feasible and acceptable abatement method to correct this hazard is to enforce the use of seatbelts during the operation of the forklift through training/re-training in accordance with company policy and the American Society of Mechanical Engineer (ASME) Safety Standard for Low Lift and High Lift Truck, ASME/ANSI 56.1-2000, Section 5.3.19.
