North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)a fall from elevation that included being struck by a mortar pan and platform. Employees were working 9.5 feet above the ground on an unguarded platform that rested unsecured on the forks of a powered industrial truck while working at Hendrix Batting Company, Inc., 2310 Surrett Drive, High Point on 1/20/05. Among others, one feasible and acceptable abatement method would be to provide employees with extension ladders on which to stand while performing required tasks.ed
