Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught in hazards: In the Fabrication Area, employees are exposed to the hazard of being caught in the point of operation on the Cincinnati 225 ton press brake, due to the fact that the foot pedal used to initiate the stroke of the machine is not guarded to prevent unintended actuation and springs used in the clutch brake mechanism are not compression springs guided on a rod or in a hole. Among other methods, one feasible and acceptable abatement method to correct this hazard is to operate the press brake in accordance with ANSI B11.3-2002, American National Standard For Machine Tools - Safety Requirements for Power Press Brakes which states the following: Brakes and clutches of mechanical press brakes shall be actuated in a coordinated manner. The clutch shall not fail to disengage and the brake shall not fail to engage upon release of the actuating force. Friction brakes shall be engaged by compression spring(s), guided on a rod or in a hole and be prevented from interleaving. A disengaging force shall be required to release the brake. Brake capacity shall be sufficient to stop the motion of the ram when the disengaging force is removed and to hold the ram and its attachments at any point in the ram's travel. When provided, foot controls shall be protected to prevent actuation from falling or moving objects, or from unintended actuation.
