Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of being caught in the point of operation on a
400 ton press brake
due to the foot treadle used to initiate the stroke of the machine was not
guarded to prevent
unattended actuation.
In the Fabrication Area, the employer does not protect the employees by
guarding the foot
treadle from unattended actuation.  The violation was most recently noted
on October 20, 2006
when an employee was observed operating the Cincinnati 400 ton press brake
which did not have
a guard over the foot treadle and exposed the employee to an amputation
hazard.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to operate the press brake in accordance with ANSI B11.3 - 2002, American
National Standards
For Machine Tools Safety Requirements For Power Press Brakes.  This would
include when
provided, foot treadles of the type that serve as an operator control
shall be equipped with a
means to prevent unattended machine actuation.
Two methods of fulfilling this requirement are, but not limited to the
following, provide a
protective cover over the treadle bar to prevent unattended machine
actuation; or, provide a
locking pin or locking lever to lock the treadle bar in a fixed position.
The locking mechanisms
should be designed to prevent unattended machine actuation. The locking
mechanism should not
allow locking in the operating position.
Pursuant to 29 CFR 1903.19, the employer must submit documents describing
the steps it is
taking to guard the foot treadle and to ensure the guard remains in place;
its schedule for
completing these actions; and what it is doing to protect employees until
the
guard is installed.
DIERSZEN-KEWANEE HEAVY INDUSTRIES, LTD WAS PREVIOUSLY CITED FOR A
VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD WHICH
WAS CONTAINED IN OSHA INSPECTION NUMBER 308566363, CITATION NUMBER
01, ITEM NUMBER 001, ISSUED ON 06/07/2005, WITH RESPECT TO A WORKPLACE
