Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)University of Guam - Employees operated: 1. A Smiton excavator with a jack hammer attached, breaking lattle rocks in a trench. Nuts and bolts were used as coupling pins to hold jack hammer in-place. 2. A Catpillar backhoe, model-416 was used to move a compactor and dig around the project site. Metal rods were used as coupling pins to the front shovel and outrigger pads. 3. A Daewoo excavator, model-DH2000, 3/8 inch rebars were welded to hold shovel in-place. The excavator and backhoe had metal rods, rebars and nut and bolts, instead of the pins originally provided by the manufacturer, to secure the shovels, jack hammer and outrigger pads. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THE HAZARD IS: 1.To follow the Association of Equipment Manufacturers (AEM) "Safety Manual for Operating and Maintenance Personnel" which requires that damaged and missing parts are repaired or replaced, and 2.To follow the Manufacturer's Operator Manual by using only service parts meeting manufacturer specifications, and 3.To train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs before equipment is placed back in service.
