Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by material falling out of the
hook on a material
hoist:
a)Milling Room: The hook of the Budgit 1/2 ton electric hoist was not
equipped
with a safety latch, on or about 5/12/2005.
ABATEMENT NOTE: Among other methods, one feasible and acceptable method to
correct
this hazard is to equip the hoist with hooks with safety latches as
described in ANSI B30.16-
1993 Section 16-1.2.9 (hooks). A latch shall be provided to bridge the
throat opening of the
hook and retain, under slack conditions, such items as, but not limited
to, slings and chains.
