Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) 5 Evans Street, Fairfield, NJ 07004 in the Shipping and Receiving Dock Area Employee(s) was exposed to the hazard of being struck by trucks being backed up to dock doors. Violation occurred on or about 04/01/2005 Among other methods, a feasible method to eliminate or materially reduce this hazard is to initiate a procedure which ensures that employee(s) are not in danger areas where and while highway trucks are maneuvering. Department of Transportation, Federal Motor Carrier Safety Administration(FMCSA) in Educational and Technical Assistance(ETA), Guide to Improving Highway Safety, guidelines for Backing Accident state that contributing factors to the accidents were driver failure to get out of cab and check proposed path of backward travel, depending solely on mirrors when it was practicable to look back and relied solely on a guide to help him/her back.er
