Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment free from recognized hazards that were causing or likely to cause serious physical harm or death in that an employee, working at the Burnett- Sloan Unit performing his job duties was exposed to a struck by hazard from a separator. Burnett- Sloan Unit, Powell, TX - On or about November 3, 2006 an employee was fatally injured when he was struck by a separator. The employer failed to select the correct safety relief device for the required service. The employer selected a safety relief valve designated for general purpose gas and air service rather than a valve to be used in a "sour" corrosive environment. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to specify a safety relief device designed to operate in corrosive atmospheres.

The employer failed to develop an inspection and testing program to assure that the safety relief valve maintained on-going integrity and functioned as designed. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to implement an inspection and maintenance program per Sections 6 and & of API Recommended Practice 576, Inspection of Pressure-Relieving Devices.
