Section 5(a)(1): of the Occupational Safety and Health Act of 1970:
Jobsite located at Abbott Drive, Omaha NE - The employer failed to furnish
employment and a place of employment which were free from recognized
hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a struck by hazard. Employees were planting small
ornamental plants in the median of a divided highway while not wearing
reflective
vests.
Among other methods, one feasible and acceptable method to control the
hazard is to:
1) Workers close to vehicle traffic should wear bright, highly-visible
clothing at all
times as outlined in ANSI D6.02 adopted by the U.S. Department of
Transportation
Manual on Uniform Traffic Control Devices - December 2000.
2) Develop and implement written procedures to have workers and supervisors
exposed to vehicular traffic wear bright, highly-visible/reflective
clothing.
3) Develop, implement and an inspection policy to verify compliance with
personal
protective equipment use.
4) Develop and enforce a progressive disciplinary program to ensure
compliance by
supervisors and employees.
Abatement certification and abatement documentation is required for this
violation. The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful. The
abatement certification sheet is enclosed with the citations.ion
