Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that employees were exposed to: Crushing hazards.
(a)On or about August 01, 2006 an employee was operating a backhoe/ loader
without following the manufacture's recommendations for safe shutdown, the
employee
had not been trained in hazards/ warnings and safety procedures contained
in the
manufacturers manuals. Page 36 of the safety manual instructs operators in
a safe shut
down procedure.The operator did not stop the engine, lower all the
attachments to the
ground, and remove the ignition key.
One feasible and useful abatement method to correct this hazard is to:
1) Follow the manufacturers safety manual
2) Train the employees required to use the backhoe/ loader as recommended
by the
manufacturer.
