29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. (a) At the trench - On or about September 10, 2019 the employer did not ensure that employees wore hard hats while exposed to head injuries working in and around the trench near the excavator.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Inside the trench - On or about September 10, 2019, the employer did not ensure that fall protection was provided for and used by employees who were exposed to a fall hazard while working on top of the fuel tank 10 feet above the ground.
