Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about January 07, 2006-at the above addressed jobsite, employees were performing masonry operations. Employees were exposed to struck by injuries, when an operator using a GEHL RS8-44 telescopic handler was placing a mortar bucket under a floor of erected precast concrete. The operator extended the boom to place a mortar bucket as close to the work area as possible. The operator was backing up and retracting the boom when the mast hit the steel I-beam causing the precast members to fall onto an employee. Feasible and acceptable abatement methods include, but are not limited to the following: a. Follow the RS8-44 GEHL operator's manual which states."Always check the job site for terrain hazards, obstructions and people". b. Follow the Equipment Manufactures Institute (EMI) safety manual for operator and mechanics of rough terrain forklifts which states, "Insure that adequate clearance is provided between both rear tail swing and front fork swing of the forklift to avoid injury to personnel or damage to objects nearby.
