North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) within the maintenance facility, the in-ground, hydraulic, two-post lift had not been inspected by a qualified inspector nor maintained by qualified or preventative maintenance personnel as required. REFERENCE: American National Standard Institute/Automotive Lift Institute Standard for Automotive Lifts - Safety Requirements For Operation, Inspection And Maintenance (ANSI/ALI ALIOIM-2000): Chapter 5, Periodic Qualified Inspection; and Chapter 6, Maintenance.
