North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by/caught in: a) within the facility, maintenance area, the in-ground, hydraulic, two-post automotive lift was noted that within twenty minutes, the lift had descended four inches (46 1/8" at 10:10 am, 45 1/2" at 10:20 am and 42" at 10:30 am) and safety requirements for operation and inspection had not been performed. REFERENCE: American National Standard Institute/Automotive Lift Institute Standard for Automotive Lifts - Safety Requirements For Operation, Inspection And Maintenance (ANSI/ALI ALOIM-2000): Chapter 4, Operation; Chapter 5, Periodic Qualified Inspection. NOTE: BEST BRAKES OF THE CAROLINAS, INC DBA VALUE BRAKES HAS BEEN CITED 1 TIME WITHIN THE LAST 3 YEARS FOR VIOLATIONS OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, NORTH CAROLINA GENERAL STATUTE 95-129(1), WHICH WAS CONTAINED IN THE FOLLOWING OSH INSPECTION: NUMBER 309157170, CITATION 1, ITEM 01, ISSUED ON 08/18/2005.
