Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling debris from building structures: In the following instances employees were exposed to serious hazards from faulty building structures: a)Building #3 Roof (cold end of kiln) - The roof of this building has deteriorated to the point of where the plywood portion of the roof has become separated from the roof. This may result in roof material being blown off the roof in electrical fires. d)Building #1 (Scrubber water to #9 Building) - The wooden cross bracing beam with cracks on the side and underside provides evidence that the beam is splitting and separating. This may result in the cross beam collapsing. e)Building #223A - The underside of the concrete ceiling is spalling and pieces have fallen into the doorway below. This may result in larger sections of debris striking employee. One feasible means of abatement is to follow the recommendations of the Sandwell Engineering Report.ring

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a forklift truck: Yard - An employee in the yard was observed operating a Clark forklift without engaging the seat belt as required in ASME B56.1-1993. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train or re-train all forklift operators on the hazards and requirements to use seat belts at all times, and ensure their use at all times when operating forklifts.
