Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about February 20, 2007 - An employee was riding inside the bucket of a tracked excavator as a means of entering and exiting an approximately 8-foot 9-inch deep excavation. Among other methods, feasible abatement methods include: (1) Prohibit the employees from riding on the excavator or in its attachments. (2) Provide employees with a safe means of access to/from excavations (ladder or structural ramps). ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
