Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards of being struck by a 250 pound post
being lifted by a
aerial lift.
North side of the building- On July 2, 2007 at 10:00 am, an employee was
using a
JLG, model number 600AJ, serial number 0300111558, as a crane to lift a
250 pound 14
foot 6 inch long PVC post, which exposed the employee in the basket to a
hazard of being
crushed between the guardrail and the ceiling of the building, and exposed
the employees
under the lift and post to being struck by either the post and/or the lift
itself; this action was
against manufacturers' recommendations (Section 1, page 1-7 of the owner's
manual for the
JLG, Model Number 600AJ aerial lift); according to consensous standard
ANSI
A92,5 1980,
Section 13.2.1 the work platform shall be used in accordance with the
manufacturers'/owners
operating instructions and safety rules.
Among other methods, one feasible and acceptable method to abate this
hazard is for
the employer to use a crane to lift the post into place.
ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE
WITH THE REQUIREMENTS OF 29 CFR 1903.19(d).
