Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards and crush injuries due to a foot pedal that was not guarded to prevent unintentional operation:: a.) Back Bay - The Cyril Bath Hydraulic Press Brake was operated by engaging a foot pedal that was installed on the treadle bar which extended across the lower front side of the press brake. A guard was not in place over the foot pedal to prevent unintentional operation, activation, and/or cycling of the press brake. ABATEMENT NOTE: Among other methods, feasible and acceptable methods to correct the condition include: A.) Equipping the foot pedal with a guard to cover the top and sides of the pedal.
