Section 5(a)(1) of the Occupational Safety and Health Act of 1970 - The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to inadequate curbs and guardrails on the batch plant
two-story loading ramp:
a.) Ramp to top of batch plant - employees required to drive the CAT IT28B
#1205 front end
loaders equipped with 4ft diameter tires up ramp to deliver cement
materials to top of batch
plant.  Guardrails on ramp are broken or missing in several areas and 11
inch high curbs are not
sufficient to prevent vehicles from driving off ramp and seriously
injuring employees in a fall.
ABATEMENT NOTE:
Among other methods, feasible and acceptable means to correct the
condition include repairing
and/or installing berms/curbs that comply with MSHA regulation 30 CFR
56.9300
and National
Safety Council guidelines.
30 CFR 56.9300 - states "Berms or guardrails shall be provided and
maintained on the banks
of roadways where a drop-off exists of sufficient grade or depth to cause
a vehicle to overturn
or endanger persons in equipment.  Berms or guardrails shall be at least
mid-axle height of the
largest self-propelled mobile equipment which usually travels the roadway."
