Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a) Hyster Lift Truck, model H50XL, serial # C177B03260L, on or about 5/6/06: Dumpster used as platform by employees was not secured to the forks of the truck. ABATEMENT NOTE: Ensure that an approved lift platform and that the platform is secured to the lift truck per American National Standards Institute, ANSI B56.1- 1993, section 4.17.3(b). b) Hyster Lift Truck, model H50XL, serial # C177B03260L, on or about 5/6/06: A pallet used as platform by employees was not secured to the forks of the truck.
