Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD SHOULD THE HOIST AND/OR BELOW-THE-HOOK DEVICES FAIL: a)Pot packing area, on or about 09/08/2010, a Beacon Line Crane, 1-ton jib hoist had been modified by welding two (2) flat metal bars to the hook and it was never load tested after the modification was not recorded annual inspections had been conducted. Among other methods, several feasible and acceptable abatement methods to correct this hazard are to: 1.Ensure that any modification, upgrade, re-rating, or modernization of hoisting equipment is performed as authorized only by the original equipment manufacturer or a qualified person and then statically and dynamically load tested with a written report of the test maintained in accordance with ANSI B30.16.-1993, Overhead Hoists, Section 16, Load tests. 2. Ensure frequent and periodic inspections are conducted and records or an external coded mark be used to identify the completion of the inspection in accordacne with ANSI B30.16.-1993, Overhead Hoists, Section 16, Inspection. b)Pot packing area, on or about 09/08/2010, a locally designed and fabricated below-the-hook pot lifting device, was being used to lift pots weighing in excess of 1000 pounds, and it had not been initially tested and rated, inspected, or marked. Among other methods, several feasible and acceptable abatement methods to correct this hazard are to: 1.Ensure that all new, altered or modified below-the-hook lifting devices,are properly tested, rated, and marked in accordance with ANSI B30.20-1993, Overhead Hoists, Sections 20, Inspection and Testing. 2.Ensure frequent and periodic inspections are conducted and records or an external coded mark be used to identify the completion of the inspection in accordance with ANSI B30.20.-1993, Below The Hook Lifting Devices, Section 20, Inspection. Abatement certification must be submitted for these items.
