North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees where employee was not wearing a seat belt while operating skid steer equipment: a)throughout the facility, employee operating a John Deer Model 312 Skid steer, no seat belt was worn, exposing employee to a thrown from and struck by vehicle hazard. Among other methods, one and acceptable method to correct this hazard is to ensure that operators are wearing seat belts while operating skid steer loaders.
