North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a)facility - big mill, where combustible wood dust up to 3-inches thick had accumulated on horizonal surfaces including piping, beams, and electrical equipment such as the top of lighting fixtures due to poor housekeeping. b)facility - shaving silo, where combustible wood dust up to 8 inches thick had accumulated on horizonal surfaces such as top of electrical enclosures. One feasible and acceptable method of abatement, among others, to correct this hazard is for the employer to follow the procedures in the NFPA document 664, Standard for the Prevention of Fire and Explosions in Wood Processing and Woodworking Facilities.
