Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 2/15/06, the forklift operator west of the Fabrication Shop was exposed to being struck by an overturning forklift because the employer did not require the use of an operator restraint device. Among other methods, one feasible and acceptable abatement method to correct this hazard as referenced in ASME B56.1 - 1993 is to used a restraint device. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS NOT REQUIRED FOR THIS VIOLATION.
