Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and/or caught in hazards while engaged in the staging of gas pipe. a)Midwest Terminals of Toledo International - Toledo, Ohio: on or about October 2, 2007, the crane operator was not in continuous communication with the ground crew who were exposed to the hazard of being struck and crushed by overhead loads of gas pipe that were being stacked in the staging yard with the use of a crane. A signal person or other communications were not provided to effectively inform the crane operator when the ground crew was in a safe location for the lift. Among other methods, one feasible and acceptable means of abatement would be to use a signal person or other effective means of communication in accordance with 5-3.1.3(c), (d) and 5-3.3 of ASME B30.5-2004. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
