Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that:
On or about August 1, 2006, employees who were working in the North bound
lane of traffic
were exposed to the hazard of being struck by a motor vehicle:
a) The employer, by not using channelizing devices to redirect North bound
traffic from the
left lane to the center lane exposed employees to the hazard of being
struck-by a motor
vehicle.
b) The employer, by not positioning the vertical panels along the tangents
of the work area
such that the alternating orange and white stripes sloped downward at an
angle of 45 degrees
in the direction motor vehicle traffic was to pass, exposed employees to
the
hazard of being
struck-by a motor vehicle.
Among other methods, one feasible means of abatement includes but is not
limited to
compliance with Part 6 of the Manual of Uniform Traffic Control Devices,
Millennium
Edition, Chapter 6C and 6F.
