Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed by a falling masonry chimney which was being demolished. a)Site - Employees were entering the danger zone of potential chimney stack collapse on two occasions after explosions weakened but failed to bring the chimney structure down. ABATEMENT NOTE: Among other methods, one feasible and acceptable method of abatement would be not to allow employees to enter the zone of potential collapse before a competent person evaluates the structure for structural stability and collapse potential.
