Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls: a)Sulfuric Acid Department - The loading area platform adjustable gangway/stair unit, which formed a guardrail equivalent when in the stored or "up" position, had an inoperative locking mechanism which failed to hold the stair unit in place, exposing employees to a fall of 11 feet, on or about 1/12/06. Among other methods, one feasible and acceptable method to correct this hazard is to follow the Carbis Inc. instruction manual for operation and maintenance under Maintenance item 1. Visually inspect the unit before each use. Replace any damaged parts. Monthly inspection of the unit is recommended as a minimum. Harsh atmosphere and/or heavy use may dictate more frequent inspections and lubication.
