Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to crushing injuries from inadvertent movement of
the bucket as an
employee was lifted in the bucket of a backhoe/loader: a hazard recognized
by the A.E.M.
the Association of Equipment Manufacturers.
a)An employee was lifted in the bucket of a Caterpillar 420D Backhoe
Loader to
unhook a chain attached to metal shoring that was being installed for a
water
line.
While ultimate responsibility for correcting the hazard rests with the
employer, given his/her
superior knowledge of the work place, feasible and acceptable methods to
correct the hazard
among others, include:
1.Train employees and enforce safety rules ensuring that employees are not
to be
lifted or ride in the bucket of a backhoe/loader.
2.Use ladders or other acceptable means to access and remove a hook from a
load.
3.Use a pole or other tool to release a hook or chain from a load.
Abatement certification is required for this violation (using the
CERTIFICATION OF
CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating
that
abatement is complete must be included with your certification.  This
documentation may
include, but is not limited to, evidence of the purchase or repair of the
equipment,
photographic or video evidence of abatement, or other written records.
