Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee was exposed to falling or being thrown from the bucket of an excavator. a.)Memorial Avenue Arlington National Cemetery, Pipe construction project- Employee was positioned in the bucket (scoop) of a Hitachi 450 excavator, moved out over a 12-foot deep excavation, so that a plumb line could be dropped to the concrete pipe below. Another employee near the excavation was working in conjunction with the employee in the scoop, operating a laser. On or about 28 June 2006.
