(scoop) of a Hitachi 450 excavator, moved out over a 12-foot
deep excavation, so that a plumb line could be dropped to the
concrete pipe below.  Another employee near the excavation
was working in conjunction with the employee in the scoop,
operating a laser.  On or about 28 June 2006.
