Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Operator on the Hertz Aerial Scissor Lift, Serial Number unknown, could not read or understand the manufacture operating instructions and user's safety rules in it's printed version. Among other methods, one feasible and acceptable abatement method to correct the hazard is: To comply with ANSI/SIA 92.6, Para 7.7(1) through 7.7 (4), the operator has been instructed by a qualified person in the intended purpose and function of each control, read and understood the manufacture operating instruction and user's safety rules.
