29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: 1) On December 15, 2011, Midwest Partitions, Inc., as the exposing employer, did not ensure that employees were protected from fall hazards, where the top edge height of guardrail systems were 42" ,plus or minus 3", in height from the working level at the following locations: a) The second floor HVAC shaft where the wire rope top rail sat at approximately 37" above the working level.

29 CFR 1926.502(b)(4): When the 200 pound (890 N) test load specified in paragraph (b)(3) of this section was applied in a downward direction, the top edge of the guardrail deflected to a height less than 39 inches (1.0 m) above the walking/working level: 1) Midwest Partitions, Inc., as the exposing employer, did not ensure that employees were protected from fall hazards, where the top edge of guardrail systems deflected to a height less than 39" above the working level at the following location: a) The 2nd floor stair landing, where the top rail of the wire rope guardrail system, which sat at approximately 40" above the working level, deflected to a height less than 39" when light pressure was applied by hand.
