MN Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees; specifically: There were two instances where employees were working from personnel baskets on a three story building without the use of a personal fall arrest device. Both personnel baskets were supported by all terrain forklifts that were used at Village Cooperative of Fairmont.
