29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: (a) K & S Construction of Fergus Falls, Inc. at The Pines, Building D, Minot, ND 58701: On or about October 26, 2011, the employer did not ensure that employees wore safety glasses when using or working in the vicinity of pneumatic nail guns. Condition exposed employees to the hazard of projectiles to the eyes.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems. In addition, the employer did not meet the requirements of 1926.502(k) in that a fall monitoring system was not in use: (a) K & S Construction of Fergus Falls, Inc. at The Pines, Building D, Minot, ND 58701: On or about October 26, 2011, the employer did not ensure that employees were using fall protection when sheathing the roof with a 4 in 12 pitch, and when extending out the gabled roof eave. Condition exposed employees to fall hazards of up to 30 feet.
