Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by/run over hazard: The Euclid dump truck number A-12 was not provided with an operable backup alarm exposing employees working in close proximity to it, to the hazard of being struck-by/run over by the dump truck as it backs up. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to remove it from service until such time as a replacement back-up alarm could be located and installed.
