Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: At the jobsite on or about 12/14/06, the employer allowed employees to use a CAT rough terrain type forklift, model TH63, serial number 5WM02118, without inspection and repair of the forks as required by ASME B56.6-2002. The employees were exposed to the type of hazards associated with struck by falling load due to failure of forks. Among others, one feasible and acceptable method of abatement would be to comply with the requirement of ASME B56.6-2002, Safety Standard For Rough Terrain Forklift Trucks, section 7.2.15 (a), Inspection and Repair of Forks.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: At the jobsite on or about 12/14/06, the employer allowed an employee to pass under the elevated portion of a CAT rough terrain type forklift, model TH63, serial number 5WM02118, with a suspended load. The employee was exposed to the type of hazards associated with struck by due to failure of the hydraulic system. Among others, one feasible and acceptable method of abatement would be to comply with the requirement of ASME B56.6-2002, Safety Standard For Rough Terrain Forklift Trucks, section 6.2.7, "do not allow anyone to stand or pass under the elevated portion of any rough terrain type forklift truck, whether empty or loaded."
