Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: multiple injuries and or death from falls from an
improperly used basket on
a rough terrain fork truck:
a) Employees were exposed to multiple injuries and or death created by the
use of an
elevated work platform which was not designed, constructed, and/or used in
accordance with
the acceptable requirements of the American Safety Standards for Rough
Terrain Forklift
Trucks, ASME / ANSI B56.6-2002 and other acceptable industry practices.
The platform did
not meet the following design and use requirements of ASME / ANSI B56.6a
of Section 5.15
and 8.24 in the following areas:
(1) Section 8.24(f) Platform did not have the maximum work load and empty
weight
information
prominently marked on the platform,
(2) Section 5.15(b) and 8.24(h) The platform was not secured to the
lifting mechanism
(3) Sections 8.24(l) and 5.15(k) Restraining means were not provided or
used, and
(4) Section 5.15(u) Personnel did not maintain firm footing on the
platform floor unless secured
by body belt or lanyard.  Personnel also used railings for the purpose of
achieving additional
reach or height, which is prohibited by this paragraph.
a) At the site, the platform was not marked with a workload or empty
weight marking
placard, the basket was not adequately secured to the lifting mechanism,
and personnel were
standing on the railing without adequate fall protection in order to
perform work.
Among other methods, feasible and acceptable means to correct these
hazards
are to use
safer alternate methods such as a scaffold or use a platform approved by
the manufacturer
meeting the design, manufacture, and requirements os ASME / ANSI
B56.6-2002 for all
attachments on rough terrain forklifts
No Abatement Certification or Abatement Documentation required.
