Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to burn, crushing, laceration and amputation hazards created
by getting struck by
or run over by a paver:
Job Site - On 6/21/06, an employee received an amputation to his lower leg
when he was
partially run over by a paver.  The employee was shoveling the mix from
the sides of
the paver's hopper into the auger section of the hopper.  The employee was
walking
backwards performing his task while the paver was moving forward, towards
him.  The
employee tripped on a manhole cover and the paver ran over his leg,
severing the lower
portion.
Among other methods, one feasible and acceptable abatement method to
correct the hazards is
to have an employee dedicated to observing or monitoring the operation and
for that monitor to
have voice communication with the paver operator at all times so that
injuries to "exposed"
employees can be eliminated.
