North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to varicella virus without adequate provisions to
protect employees:
a)site, Freedom Lake Dialysis Center - employer failed to provide a policy
and/or program for
employees exposed to direct care of patients with suspected varicella
infection (shingles or
chicken pox).
Examples of these feasible and acceptable abatement methods include, but
are not limited to: an
immunization program which incorporates guidelines from a recognized
authority
such as the Centers
for Disease Control and Prevention.  It is recommended that all healthcare
workers be immune to
varicella. Evidence of immunity in HCWs includes documentation of 2 doses
of varicella vaccine given
at least 28 days apart, history of varicella or herpes zoster based on
physician diagnosis, laboratory
evidence of immunity, or laboratory confirmation of disease.

North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to falls:
a)site, Freedom Lake Dialysis Center attic - employer failed to provide
appropriate stair rails on
all open sides of the ship's ladder/stair leading to the roof access.
Examples of these feasible and acceptable abatement methods include, but
are not limited to: provide a
personal fall protection system until a suitable stair rail system is
installed.  A suitable stair rail system
would have, for each exposed side, a top rail installed at a height not
more than 44 inches and no less
than 34 inches from the surface of the tread in line with the face of the
riser at the forward edge of the
tread and be able to withstand a concentrated load of 200 pounds.
