North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to being struck by or crushed by heavy steel and
aluminum frames:
a)facility, letter department - where employees were allowed to operate
overhead, underhung
hoists to lift and lower items such as, but not limited to,  1200-pound
aluminum and steel
frames using hooks that were not equipped with safety latches and hooks
that showed significant
wear.
ABATEMENT NOTE: One feasible and acceptable abatement method, among
others, is to
conduct frequent and periodic inspections of the hooks and to take the
hooks
out of service
when defects, such as the wear or missing safety latches, are discovered.

North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to flash fire or explosion hazards in the
event of ignition of the combustible
aluminum dust or chips:
a) facility, letter department - where employees were allowed to use
machines including, but not
limited to, a Delta 10" compound miter saw (model 36-200, type 3) and a
Dynabrade 3/16"
orbital sander (model 59020), that produce fine particles of aluminum and
were not equipped
with dust collection systems.
ABATEMENT NOTE: One feasible and acceptable abatement method, among
others, is to
provide dust collection and transport devices to all pieces of equipment
that produce fine
particles of aluminum.

NFPA 484, 2006 Edition, Paragraph 6.3.2.1 Machines that produce fine
particles of aluminum
shall be provided with hoods, capture devices, or enclosures that are
connected to a dust
collection system having suction and capture velocity to collect and
transport all the dust
produced.)
b) facility, letter department, sanding room - for employees who were
allowed to work in the
sanding room and letter department where aluminum dust was allowed to
accumulate on
surfaces, equipment, and structural beams.
ABATEMENT NOTE: One feasible and acceptable abatement method, among
others, is to
safely remove all present fugitive dust through methods recommended by the
National Fire
Protection Association and to then develop and implement a regular
housekeeping policy to
prevent future accumulation.

allowed to accumulate.)
c) facility, letter department - where employees were allowed to work in
close proximity to
aluminum chips that were allowed to accumulate on circular miter saws,
including,
but not
limited to a Delta 10" compound miter saw (model 36-200, type 3) and were
not collected and
removed daily.
ABATEMENT NOTE: One feasible and acceptable abatement method, among
others, is to
implement and enforce a housekeeping policy for daily collection and
removal of aluminum
chips in closed-top containers to a safe storage or disposal area.

lathe turnings,
raw turnings, and swarf shall be collected in closed-top containers and
