General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Adelup (Anigua) Curve- A Caterpillar Backhoe, Model-426, Guam License-939SEQ, was used to excavate around a concrete vault box. A modified cotter pin was used in lieu of an original pin to secure the Backhoe outrigger pads. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD IS: 1.To follow the Association of Equipment Manufacturers (AEM) "Safety Manual Operating and Maintenance Personnel" which requires that damaged and missing parts are repaired, and 2.To follow the Manufacturer's Operator Manual by using only service parts meeting manufacturer specifications, and 3.To train the operators and maintenance personnel to inspect equipment for defects and complete service repairs before equipment is placed back in service
