Section 5(a)(1) the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by a forklift in the event of a rollover: a) 322 Third Street, Elizabeth NJ. The employer failed to require employees to wear restraint devices when exposed to tipping hazard(s). Condition noted on or about 03/09/07. AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO REQUIRE EMPLOYEES TO UTILIZE THE SEATBELTS DURING FORKLIFT OPERATIONS AND ADD THIS REQUIREMENT TO THE EMPLOYEES TRAINING PROGRAM.
