Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employee in that
employees were exposed to fall hazards.
a) 7 Adams Road, Martinsville, NJ 08836. Employee was allowed to work in
excess
of 10 feet above ground level from a job-made basket/platform that was
sitting on the
forks of a 6036 Sky Trak Rough Terrain Forklift (Lull).
The basket/platform was:
1) not approved.
2) missing midrail system.
3) not secured to the forks of the Lull.
4) employee left elevated while the Sky Trak was unattended.
In addition, the employee who was donning a full body harness with shock
absorbing lanyard
was not using this PFAS as designed. The lanyard was wrapped around the
carriage
of the
Lull and secured back to itself reducing it's strength.
ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD,
AMONG OTHER MEANS, IS TO FOLLOW THE GUIDANCE SET FORTH IN THE
SKY TRAK OPERATOR AND SAFETY MANUAL, WHICH PROHIBITS THE USE
OF A NON-APPROVED HOME MADE WORK PLATFORM.
