Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by a forklift in the event of a rollover: a- ASA Apple, Inc., 201 Bay Ave., Elizabeth, NJ - The employer failed to require employees to wear restraint devices (i.e., seat belts) when operating a forklift, exposing them to a crushing hazard in the event of a rollover. Condition noted on or about 1/18/08. Among other means, one feasible and acceptable method to correct the hazard would be for the company to require employees to utilize the seat belts and add this requirement to the employee's training program.
