Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that the employees
were exposed to the hazard of being crushed by the Clark and the TCM
powered industrial
forklift trucks in the event of a tip over accident.
Throughout the work site; Seat belts were not being used by the operators
of the Clark and the
TCM powered industrial trucks that were being used to move iron, trash and
tanks. The
employees were  exposed to the hazards of being crushed by potential
roll-over action of the fork
trucks.
Among other methods, one feasible and acceptable method to correct this
hazard would be to
install a seat belt on the TCM fork truck and to enforce the requirement
that the operators of
both powered industrial truck use the seat belts.
